BRIEF FACTS
 The present case pertains to the Rights of Animals under our Constitution, laws, culture, tradition, religion and ethology, which have to examine, in connection with the conduct of Jallikattu, Bullock-cart races etc. in the States of Tamil Nadu and Maharashtra, with particular reference to the provisions of the Prevention of Cruelty to Animals Act, 1960 (for short 'the PCA Act'), the Tamil Nadu Regulation of Jallikattu Act, 2009 (for short "TNRJ Act") and the notification dated 11.7.2011 issued by the Central Government Under Section 22(ii) of the PCA Act. In this case, the Animal Welfare Board of India (AWBI) has brought into the spotlight, the customs and practices involving cruelty and torture of animals for human pleasure.

HELD
The Supreme Court held that the events such as Jallikattu, Bullock-cart Races violate Sections 3, 11(1)(a), 21 and 22 of PCA Act. The Supreme Court held that rights guaranteed to bulls under Sections 3 (Duties of persons having charge over animals) and 11 (Penal provision regarding cruel treatment of animals) of PCA Act read with Articles 51A(g) & (h) are cannot be taken away or curtailed, except Under Sections 11(3) and 28 of PCA Act.

Furthermore, the Supreme Court has stressed that every species has an inherent right to live and shall be protected by law, subject to the exception provided out of necessity. Animal has also honour and dignity which cannot be arbitrarily deprived of and its rights and privacy have to be respected and protected from unlawful attacks.

The Supreme Court has interpreted the word ‘life’ in Article 21 of the Constitution, to include the basic environment which includes all forms of life, including animal life, which are necessary for human life. The Court opined that so far as animals are concerned, "life" means something more than mere survival or existence or instrumental value for human-beings, but to lead a life with some intrinsic worth, honour and dignity.

Prime Minister Narendra Modi on Saturday inaugurat Prime Minister Narendra Modi on Saturday inaugurated the Atal Tunnel at Rohtang at an altitude of above 3,000 metres in Himachal Pradesh. After the inauguration, he said the tunnel would provide new strength to the country’s border infrastructure. 

The 9.02 km-long-tunnel, built by the Border Roads Organisation (BRO), is the world’s longest highway tunnel and connects Manali to Lahaul-Spiti valley. It provides all-weather connectivity to the landlocked valley of Lahaul-Spiti, which remains cut-off for nearly six months in a year as the Rohtang Pass is uually snow-bound between November and April.

Before the tunnel construction, the Lahaul Valley used to remain closed for vehicular movement due to bad weather conditions. But Thanks to the tunnel, the people of the Valley will have round-the-year road connectivity. The tunnel reduces the distance by 46 km between Manali and Leh and the travel time by about 4 to 5 hours. It is expected to boost tourism and winter sports in the region. The tunnel, also significant from the military logistics viewpoint, will provide better connectivity to the armed forces in reaching Ladakh.

In 2019, The Union Cabinet decided to name the tunnel as ‘Atal Tunnel’ to honour former Prime Minister Atal Bihari Vajpayee for his contributions. The decision was taken in 2000 when he was the Prime Minister. The foundation stone was laid by UPA chairperson Sonia Gandhi on June 28, 2010.

*Security for third gender from sexual assault sought in Supreme Court* 

  A PIL has been filed in the Supreme Court seeking the protection of law for persons of the third gender/transgender from the sexual assault.

The petition filed by advocate Reepak Kansal states that there is no provision in the Indian Penal Code which can protect the third gender from the sexual assault by a male/ female or another transgender. Therefore, an anti–discrimination law are needed to safeguard the basic citizenship rights of transgender persons.

The petitioner seeks to challenge the constitutional validity of clauses (i), (ii) and (iv) of sub-section (1) of Section 354A of IPC, to the extent that they are interpreted to exclude victims of sexual harassment who are transgender persons, as being ultra vires to Articles 14, 15 and 21 of the Constitution of India.

He seeks direction to the respondents to make appropriate modification / interpretation of sections of IPC dealing with sexual assault to include transsexuals and eunuchs in the definitions accordingly.

आज शहीद भगत सिंह की आज शहीद भगत सिंह की जयंती है। 28 सितंबर, 1907 को अविभाजित भारत में लायलपुर जिले के बंगा में भगत सिंह का जन्म हुआ था।  “शहीद भगत सिंह साहसी होने के साथ-साथ विद्वान भी थे, चिंतक थे। अपनी जिंदगी के बारे में परवाह किये बगैर भगत सिंह और उनके क्रांतिकारी दोस्तों ने ऐसे पराक्रमिक कार्यों को अंजाम दिया, जिनका देश की आजादी में बहुत बड़ा योगदान रहा।” 

अंग्रेजी हुकूमत से देश को आजाद करने के लिए चले आंदोलनों में भगत सिंह का नाम बहुत ही गर्व से लिया जाता है। 12 साल की उम्र में जलियांवाला बाग कांड का उनके मन पर बहुत ही गहरा प्रभाव पड़ा था। 14 साल के भगत सिंह ने सरकारी स्कूलों में किताबें और कपड़ों में आग लगा दिया था। देश की रक्षा के खातिर अपनी पढ़ाई छोड़कर सन् 1920 में वो महात्मा गांधी के अहिंसा आंदोलन में शामिल हुए। 23 साल की छोटी सी उम्र में ही ब्रिटिश सेना द्वारा उन्हेंं फांसी पर चढ़ा दिया गया था।

Legendary singer SP Balasubramanyam, who had tested positive for Covid-19 , passed away yesterday at the age of 74. He was undergoing treatment at a hospital in Chennai and was admitted there on August 5 after he showed mild Covid-19 symptoms. However, in the last 24 hours, his condition had deteriorated further, warranting maximal life support. Hospital authorities had confirmed that the singer was on life support. SP Balasubramanyam reportedly had mild fever on Wednesday and the hospital authorities had stated that the singer was in extreme critical condition. Having lost a celebrated musician, the nation is in shock and fans of SP Balasubramanyam are in grief. Social media is flooded with condolences, from celebrities and fans of the late musician. 

SP Balasubramanyam has crooned over 1000 songs for Tamil, Telugu, Kannada, Hindi, and Malayalam films. He has entertained people of various generations. SP Balasubramanyam was honored with a Padma Shri (fourth-highest civilian award) in 2001 and Padma Bhushan (third-highest civilian award) in 2011 by the Government of India for his contribution to cinema.

SP Balasubramanyam started his cinematic journey in 1966 with the Telugu film 'Sri Sri Sri Maryada Ramanna' and then there was no looking back, he made an extraordinary contribution to music across many languages. *PIL in Allahabad High court to make jails less crowded to avoid Covid* 

 A PIL has been filed before the Allahabad High Court to make prisons less crowded by taking various effective measures considering the increasing cases of Corona and the health of the prisoners in the time of pandemic.

A bench of Justice Pritinker Diwakar and Justice Subhash Chandra Sharma heard this PIL yesterday and issued a notice to the state government to file its reply.

The PIL has been filed by Senior Advocate Dileep Kumar, for petitioner Man Mohan Mishra, who is a practising advocate at Allahabad High Court. It seeks direction to the Department of Prison Administration, Government of Uttar Pradesh, and the Uttar Pradesh High Powered Committee.

In his plea the petitioner has requested before the Court to consider the release of prisoners who are above the age of 65 years old or suffering from co morbidities in view of the Guidelines issued by the Ministry of Home Affairs on July 29. To make this effective the Court can ensure speedy trial and disposal of the bail applications, parole applications etc.

*Supreme Court throws out PIL wanting care for suicide-prone IIT students, imposes Rs 10k cost* 
 
 The Supreme Court today dismissed as frivolous and with cost a plea seeking prevention of suicides at IITs across the country. The court said that the authorities are alive to the problem. The petitioner was fined Rs 10,000.

A three-judge bench of Justice Rohinton Fali Nariman, Justice Navin Sinha and Justice Indira Banerjee listened to the PIL patiently for ten minutes. Then the bench told the petitioner: “We have heard you fully. The question now is of awarding cost, since it is an utterly frivolous petition.”

The petition was filed by advocate Gaurav Kumar Bansal, seeking direction for care to be given to IIT students, citing the high rate of suicides among them.

The court said authorities, as evident from petition, are alive to the situation. “The PIL is utterly frivolous and dismissed with cost of Rs 10,000,” it ordered.

Lok Sabha passed the Jammu and Kashmir Official Languages Bill, 2020 today.
 
The bill aims to make Kashmiri, Dogri, Hindi, English and Urdu as the official languages of the Union Territory of Jammu and Kashmir. 
 
Speaking about the bill in Lok Sabha, Union Minister of State for Home Ministry G. Kishan Reddy said that that the legislation will fulfill the long awaited demand of the people of Jammu and Kashmir.
 
The minister informed that earlier the official language for the Union territory was only Urdu.
 
He said the Lieutenant Governor of Jammu and Kashmir had informed the Centre that people across the Union Territory had been demanding to include the languages they speak and understand as their official language.

*Mullaperiyar dam: Supreme Court issues notice in petition against lax supervision*

 
 The Supreme Court today issued notices on the writ petition filed by Kothamangalam native Dr Jo Joseph and Kothamangalam block panchayat members Sheela Krishnankutty and Jessymol Jose in the issue of a lack of supervision of the water level in the Mullaperiyar dam.

The petitioners have alleged that the supervisory committee was evading the responsibilities given by the constitution bench. This petition was filed against the supervisory committee constituted by the constitution bench to evaluate the safety of Mullaperiyar dam. 

The notice has been issued to both the parties including Kerala and Tamil Nadu. The court also decided to hear the new writ petition along with the writ petition filed in 2017 seeking to reduce the water level in Mullaperiyar dam.

The bench headed by Justice Rohinton Nariman pointed out that a petition filed in 2017 seeking to reduce the water level in Mullaperiyar dam to the maximum was under the consideration of another bench.

Considering all the facts the apex court clarified that the writ petition against the supervisory committee can be heard along with the petition filed in 2017.

*Arjuna Awardee para-swimmer prashant karmakar moves Delhi High Court against suspension* 

Prashant Karmakar, an Arjuna Awardee and renowned  para-swimmer, has reached the Delhi High Court challenging the 3-year suspension imposed on him by the Paralympics Committee of India (PCI). Prashant was suspended on grounds of the outcome of disciplinary proceedings against him.

The plea filed through advocates Amit Kumar Sharma and Satyam Singh seeks to quash and set aside the suspension order by the disciplinary committee of the PCI. 

The matter is likely scheduled for next hearing tomorrow.

In the petition Karmakar’s advocate said the disciplinary committee did not practise the principles of natural justice and fair play. The plea read:

“In the most shocking, obnoxious, arbitrary, unreasonable and capricious manner, the disciplinary committee of PCI suspended the petitioner from participation and from his being sponsored in any sports events for three years with effect from January 20, 2018 and also recommended that his employer, the Haryana Sports Department, take disciplinary action against him.”

The petition filed by Prasanta Karmakar also sought a grant of compensation to him for being illegally, capriciously, and arbitrarily banned from participating in swimming competitions for three years by respondent PCI in violation of his fundamental right enshrined under Article 19 (1) (g).

*Supreme Court asks CBSE, UGC to take a joint decision on results and admissions* 

The Supreme Court has asked the CBSE and the UGC to take a joint decision on the declaration of results and admissions,  while hearing a plea seeking extension of college admission deadlines due to the delayed compartment exams for Classes X and XII.

Around 2 lakh students are appearing in the exams starting today. The exams conclude on September 29.

The UGC informed the court that the cut-off date for admission in colleges is October-end and if the CBSE declares results of compartment exam before that date then students will be able to take admission.

Don’t meddle with CBSE
A bench headed by Justice AM Khanwilkar was hearing the plea seeking extension of College admission deadlines since CBSE holding compartment examination in the last week of September.

The lead petitioner has impleaded the University Grants Commission in the case as the court had observed that the UGC would be fit to decide how college admission deadlines can be extended, if at all.
